General terms & conditions

These general terms and conditions form an agreement at a distance, in which the rights and obligations of TAFF BV, operating under the brand name Hellostraw-shop and of the Customer in connection with the sale of products referred to on the website Hellostraw-shop, are described.

For any question or complaint regarding the products, order, personal data, the right of return, application of warranty, the Customer can contact the Hellostraw-shop site or email address: [email protected] All content on hellostraw-shop (illustrations, texts, labels, brands, trademarks, images, videos, ...) is owned by hellostraw-shop. Any full or partial reproduction of the site is prohibited, unless Hellostraw-shop has given prior express permission. Hellostraw-shop does not give permission for the creation of hyperlinks, unless this has been explicitly agreed in advance.

Article 1, General provisions

These conditions are concluded between TAFF BV, hereinafter referred to as "Hellostraw-shop", and persons who wish to make a purchase via Hellostraw-shop. Customers are professional or private Customers. Some of the provisions of this agreement apply exclusively to professional Customers and vice versa to private Customers. Professional Customers undertake to indicate their professional status when placing their order, whereby Hellostraw-shop reserves the right to cancel the order in case of non-compliance with this obligation by the professional Customer.

Placing an order implies the full and unconditional acceptance by the Customer of the following general terms and conditions of sale, to the exclusion of all other documents such as leaflets, brochures, newsletters, ... published by Hellostraw-shop and which only have an indicative value. In this respect, the validation of the order confirms the full acceptance of these conditions by the Customer. In any case, Hellostraw-shop reserves the right not to respond to a request from the Customer that deviates from its general terms and conditions.

The fact that Hellostraw-shop does not at any time invoke one of these conditions cannot be construed as a waiver of a subsequent invocation of one of these conditions. The cancellation of any clause of these general terms and conditions does not affect the validity of the general terms and conditions as a whole.

Article 2, Products

Hellostraw-shop takes the greatest care in putting information about the essential characteristics of products online, in particular by means of technical descriptions and photographs that illustrate the products. The editorial data (photos, texts, graphics, technical data sheets, descriptions) are for the most part taken from documentation received by Hellostraw-shop, prepared by third parties and reproduced under their control and with their consent. In this regard, the Hellostraw-shop is obliged to respond to any additional requests for product information.

In no event shall Hellostraw-shop be held liable for any changes or errors in the description of the characteristics of the product purchased, unless the essential characteristics of the product are affected.

Article 3, Right of purchase

The Customer declares that he/she has the authority to conclude this contract, i.e. that he/she has reached the legal age of majority and that he/she is not under guardianship or guardianship. The Customer will place an order in accordance with the instructions given to him on the site. He undertakes to carry out the order by ensuring that the necessary information is complete and accurate. In any case, the Customer is responsible for the information provided when placing the order. In case of an error in the formulation of the recipient (name, address, etc.), Hellostraw-shop cannot be held responsible for delays in the delivery of the products.

As a reminder, the steps to complete the sale on the hellostraw-shop site are as follows:

1. The Customer chooses his products by clicking on "to shopping cart". 
2. The Customer can check the order and modify the order when needed. 
3. The Customer confirms his order by clicking on "Confirm order". 
4. The Customer provides his personal data and the delivery address of his order. 
5. The Customer confirms his order definitively by clicking on "Pay order" after he has expressly agreed these general terms and conditions and validate appropriate box. 
6. The Customer choose for a Secured Payment method (article 4).

Payment of the order by the Customer shall definitively formalise the online selling agreement concluded with Hellostraw-shop and shall be confirmed to the Customer by e-mail.

Article 4, Price and payment

The selling prices of the products mentioned on Hellostraw-shop are indicated in Pound Sterling VAT excluded. The fixed delivery costs are stated at the moment that the Customer selected the products. The amount is stated at the end of the order and requires validation by the Customer. The final invoice price includes transport and includes VAT. Hellostraw-shop reserves the right to change the selling prices at any time. However, no changes may be made after the order has been placed. The price applicable to the ordered products is the price stated on the website on the day of the order. Orders are payable in Pound Sterling, in full and in cash, where we offer various payment methods:

- Credit card (American Express, Mastercard and VISA). 
- Direct Debit cards
- PayPal
- SWIFT / SEPA / bank-wire payment

The Customer's order is processed on the date of receipt of payment.

Article 5, Availability of products

The products are offered for sale within the limits of the available stocks and delivery options of the suppliers of Hellostraw-shop. The availability of the products shall be definitively validated upon receipt of the order confirmation e-mail to the Customer.

In the event of an unforeseen circumstance that a product or one of the products ordered is not available when the order is being prepared for delivery to the Customer, Hellostraw-shop undertakes to contact the Customer by e-mail within 7 working days of receipt of the order in order to inform the Customer of the period within which missing product(s) can be delivered.

If it is impossible to deliver the product, Hellostraw-shop shall offer an alternative product of equivalent quality, characteristics and price or cancel missing product(s). In case of cancellation of the order of the relevant missing product(s), the refund will be made within 14 working days at the latest. Reimbursement will only take place by bank transfer.

Article 6, Delivery and receipt of the order

Hellostraw-shop products are available for online purchases and shipped to United Kingdom. Hellostraw-shop reserves the right to refuse any order whose delivery address is not United Kingdom. Delivery takes place at the delivery address indicated by the Customer. This is done by door delivery of indicated delivery address. The Customer can follow the status of delivery on the site of the logistic partner at any time. The delivery is deemed to have been made by hellostraw-shop at the moment that the Customer has received his order. The delivery is carried out by an independent transport company.

The Customer undertakes to sign the delivery note for the products. In case of absence of the Customer at the time of delivery, the Customer has 15 working days to collect the goods from the carrier. If this period is exceeded, the goods will be returned to the company that sent the goods at the Customer's expense. It is agreed that the Customer is responsible for re-sending the order. Deliveries are carried out according to the indicative delivery time indicated on the hellostraw-shop website. The Customer will receive an e-mail at the moment that delivery of the order has been set in motion.

In case of a delay of the planned delivery time, Hellostraw-shop will inform the Customer as soon as possible by e-mail and give a new indicative delivery time. In any case, the Hellostraw-shop undertakes to deliver to the Customer within a maximum period of 30 working days after the order confirmation. If this term is exceeded by more than 7 working days and except in cases of force majeure, the Customer has the right to dissolve the online agreement concluded with Hellostraw-shop. In this case, the Hellostraw-shop undertakes to reimburse the Customer by bank transfer within 14 working days. For professional Customers, the delivery time is given by way of indication in accordance with the possibilities of delivery and transport by the logistics partner of Hellostraw-shop, unless an explicit written commitment has been made between Hellostraw-shop and the Customer about a fixed delivery date.

In any case, the Hellostraw-shop shall endeavour to comply with the delivery time stated at the time when the goods are exported by the logistics partner. In the absence of such an obligation, the exceeding of the deadline cannot give rise to compensation for damages, withholding or cancellation of current orders. Hellostraw-shop is authorised to deliver in whole or in part. In the event of temporary or permanent unavailability of the ordered products, in particular due to the failure of a supplier, the Hellostraw-shop shall inform the Customer as soon as possible and indicate the date on which the order can be executed. It is the responsibility of the Customer to check the condition of the packaging and products and the number of products upon receipt.

In the event of a complaint regarding possible damage, missing or late delivery of a product, it is the responsibility of the Customer to state this explicitly, clearly and accurately on the delivery note and to inform the carrier of this - within 3 working days - in writing or by e-mail. Without prejudice to the measures to be taken with regard to the carrier, complaints about visible defects or non-conformity of the delivered product must be submitted in writing to Hellostraw-shop within 3 days after the date of delivery or availability of the product. It is the responsibility of the Customer to justify the defects or damages found, in particular by sending Hellostraw-shop a photocopy of the delivery note stating the reservations. He must leave it to Hellostraw-shop to detect these defects. After this period, no amicable or legal complaint from the Customer can be accepted.

NOTE: If the Customer accepts the package without verification, it will be considered undamaged and cannot be invoked at a later date.

Under no circumstances can Hellostraw-shop be held liable for delay or non-delivery as a result of force majeure or the fault of the Customer.

Article 7, Term of notice for Customers

The Customer has the right of a withdrawal period of 14 days from the date of receipt of the ordered products. The Customer must return the products, within the withdrawal period, to the sender's address, in their original packaging, unused and in perfect condition, without any trace or mark, with all accessories (including any documents). The Customer must return the product with a copy of the invoice enclosed to the sender's address. The cost of returning the products shall be borne by the Customer. If not all conditions for returning the products are met, Hellostraw-shop may revise reimbursement of the full amount. If applicable, part of the sales price can be deducted if a product or accessory is missing or packaging is damaged, and it is necessary to replace packaging for resale. Hellostraw-shop undertakes to reimburse the consumer within 14 days. However, Hellostraw-shop reserves the right to postpone the refund until the product has been received.

Article 8, Obligations of the Customer

The use of the product will be carried out under the responsibility of the Customer. Hellostraw-shop advises the Customer to use the ordered product in accordance with the safety instructions and recommendations stated on the packaging. Under these circumstances, the Customer is obliged to ensure that the product is kept in good condition and used in accordance with its intended purpose, in particular in accordance with the manufacturer's instructions. Under no circumstances can Hellostraw-shop be held liable for defects and deterioration of the delivered products as a result of abnormal or non-conforming storage, storage and use conditions after the delivery of these products.

Article 9, Liability

The Customer must provide Hellostraw-shop with every opportunity to discover such defects or deviations. In the event of a defect, the products concerned can be returned to Hellostraw-shop. Without prior written consent of hellostraw-shop, no returns will be accepted, for whatever reason. Products that are considered as conflicting by the Customer will be refunded by means of a replacement of their choice or by means of a bank transfer from Hellostraw-shop.

Any return costs are for the account of Hellostraw-shop. When hellostraw-shop is held liable, the amount of damage paid by Hellostraw-shop is in any case limited to the amount of the order. Hellostraw-shop is in no way responsible for any damage to life, body and health. Hellostraw-shop disclaims any responsibility:

- Normal wear and tear of its products 
- Damage or accidents as a result of negligence, lack of supervision or maintenance or improper use. 
- Damage resulting from modifications, installation or repairs to the product. 
- Damage resulting from non-observance of the recommendations for the use of the products mentioned in the product description.

In the event of force majeure, unforeseen event or external cause, in particular due to fire, flood, strike, company closure, travel restrictions, voluntary damage, theft, changes in the regulatory framework, inability to obtain raw materials, power supply disruptions, attacks, war, acts of terrorism, disruptions or interruptions in the electricity or telecommunications networks, the Customer shall be automatically released from his obligation to deliver, without compensation, as from the date on which the events occur, and undertakes to inform the Customer as soon as possible that it will be made impossible to comply with his obligations.

Hellostraw-shop is not liable for temporary or permanent damage to the Customer's computer system or for any loss or damage that may be suffered as a result of access to Hellostraw-shop. The transfer of data via the internet can lead to errors and/or the fact that the site is not always available. Consequently, Hellostraw-shop cannot be held responsible for the availability and interruption of the site.

Article 10, After-sales service and warranty

For products marketed by Hellostraw-shop the legal and possible manufacturer's warranty conditions apply. The warranty runs from the date of receipt of the product by the Customer. The warranty is limited to exchange or refund. The warranty is excluded in case of normal wear and tear or damage caused by misuse or improper use. Hellostraw-shop cannot be held responsible for changes to the manufacturer's warranty conditions if this is done for valid reasons. In order to be able to make use of the warranty, the Customer must be able to submit a purchase invoice, by means of a copy of the original or a document via his user account at Hellostraw-shop.

Article 11, Processing of data and freedom of action

Hellostraw-shop collects, records, modifies, uses and transmits personal data of Internet users for the purpose of processing orders placed on the site, protecting the business interests of Hellostraw-shop, including for the preservation of evidence. To the extent necessary, the Hellostraw-shop provides information to its employees and/or third parties (transport company) in order to fulfil the obligations of the agreement between the Customer and the Hellostraw-shop.

The Customer has the right to access, modify, rectify and delete the data concerning him. To exercise this right, simply send an e-mail to: [email protected]com. The use of personal information for other purposes is only possible with the consent of the Customer. By registering on hellostraw-shop, the Customer undertakes to provide sincere and truthful information about himself. Providing incorrect information is in violation of these general terms and conditions and of the terms of use that appear on the site.

Article 12, Use of cookies

For statistical and display purposes, hellostraw-shop informs the Customer that cookies store certain information that is stored in the memory of its hard drive. With these cookies, the Hellostraw-shop can also offer the Customer the offer that is most adapted to his needs and this in function of the products that he has already selected during previous visits. These cookies do not contain any confidential information about the Customer.

Article 13, Waste instructions for packaging and product

Follow your local authority's instructions for handling packaging waste and the product after use. By participating in waste sorting, the Customer will contribute to the conservation of natural resources and the protection of nature and health.

Article 14, Applicable law

The parties to the Hellostraw-shop and the Customer agree that the conditions and consequences thereof are subject to Dutch law. The language of this agreement and the relationship between the parties is English. These general terms and conditions of sale between Hellostraw-shop and the Customer shall be implemented and interpreted in accordance with Dutch law. In the event of a dispute, the Customer shall first contact Hellostraw-shop in order to obtain an amicable settlement. If this is not the case, the court where the registered office of Hellostraw-shop is located shall have jurisdiction.

Hellostraw-shop  and the Customer agree that these terms and conditions and their consequences fall under the exclusive jurisdiction of the District Court in the region where the registered office of Hellostraw-shop is located and to which jurisdiction is expressly granted in advance, even in the event of a warranty claim by several defendants. The language of this agreement and of the professional relations between the parties is English.
